Privacy Here at Host Wave.com LLC, we understand the importance of your privacy:
Host Wave.com LLC will never willfully disclose individually identifiable information about its customers to any third party without first receiving that customer's permission.
Information may only be released should a US Court request the information by a Subpoena. The Customer will be notified, with reasonable time that their information is being requested.
Web Hosting and Image Hosting User Policy - Notification to Customer:
This Terms of Use is emailed and presented to every customer at time of subscription, while requesting technical support and closing of any Host Wave.com LLC Web Service.
Web Hosting (Paid or Sponsored):
Host Wave.com LLC can not be held responsible, liable for any downtime on or of your web pages, blog, email, images, files, database, shopping cart, or service/s. By choosing ANY of Host Wave.com LLC web services found at Host Wave.com LLC - YOU (Subscriber/Client) accept this policy.
Image Hosting (Paid or Sponsored):
Image Hosting Accounts (3 Day Trial):
Host Wave.com LLC subscriptions that are cancelled during the 3 Day Trial period by the Customer will receive an email notice letting the Customer know that we received information that their payment for their subscription was cancelled. Host Wave.com LLC has the right to "lock" the account should the subscription be "unsubcribed" by the user or the payment processor with or without notice. Unlocking of the account will be made available after payment has been received.
Suspension of an Account (a Web Service):
Host Wave.com LLC reserves the right to suspend an account with or without prior notice (For example, non-payment, violation of HostWave's Terms of Use, etc). Host Wave.com, LLC will email the registered user to why a suspension or removal of an account was taken by either the payment processor or HostWave.com, LLC. Account Users are given a 24 Hour Notice, which is considered "reasonable time" by email describing their account will be suspended or removed should payment not be made to Host Wave.com, LLC. HostWave.com, LLC will reinstate most locked/ suspended accounts at the descretion of an Officer of HostWave.com, LLC. For details of payment types and fees for image hosting or web hosting.
Removal of Account (a Web Service), such as Images and Videos:
Host Wave.com LLC reserves the right to cancel or suspend an account with or without prior notice. Reasons for canceled or removed account; Excessive Bandwidth, Fraud, Donation Pages and Shopping Cart, Hate, Racism, Pornography, Copyright Infringement. Host Wave.com LLC may or may not email the registered user to why a suspension or removal of an account was taken. Account Users are given a 24 Hour Notice, which is considered "reasonable time" by email describing their account will be suspended or removed should they of violated our Terms of Use Agreement or payment for the subscription has not be made to Host Wave.com LLC. If any images or videos uploaded by the user which includes excessive bandwidth we may delete the image or video from our servers with no prior notice and, at our discretion, suspend or terminate the image or video.
Downtime or Halt Service:
Host Wave.com LLC can not be held responsible for any downtime or non-response of images, website web pages, scripts, email and database. Host Wave.com LLC will make a diligent effort to reinstate any service offered. Host Wave.com LLC will perform a duty of care and provide service to the customer with reasonable time and support on the matter.
Login Required (Continuously - Within 30 Days):
All current and future Host Wave.com LLC Picture Hosting Accounts must login once a month to their Picture Hosting Accounts either http://www.Hostwave.com or at http://www.Cheap-Picture-Hosting.com. If you do not logon to your Picture Hosting Account once a month, we will consider your account abandoned and will remove all images, files, user information and close the account. If your account appears to have not been accessed within thirty (30) calendar days, your account will be closed and files will be removed without notice.
Your Host Wave.com LLC account must match your PayPal account's primary email address. Be sure to check your Picture Hosting account and have this email match. Reason: Because images and files take up hard-drive/ disc space - and an account not being used or accessed is an account's disc space that should be available for use. This helps us keep our Picture Hosting Plans at a really low cost.
Payment:
Payments for any Host Wave.com LLC web service is only accepted electronically. To keep your account active, online and to avoid suspension and or removal of your account, payment must be made to Host Wave.com LLC by one of the following payment processors Paypal or 2Co.com. Host Wave.com LLC reserves the right to cancel any account who has failed to make payment for a web service. Your Host Wave.com LLC account's email address must match the email address used when you signed up and made the first and continued payment.
Refunds:
30-Day Money Back for web hosting via Paypal.com or 2Checkout.com online transactions. We quickly respond to all refunds and resolve requests by the next business day. All sales are final after the 30 Day for web hosting and for the 3 Day Trial for image hosting. No refund after the Trial Period has expired. Refunds do not apply to locked/ suspended web hosting and image hosting accounts.
All refunds during the Trial Period must be requested by submitting a written request via email to support @ hostwave.com. Requests must include your full name and phone number, username (image hosting or web hosting accounts), server name, and receipt of payment and or domain name (web hosting accounts only) and email address used at sign-up. Mediation or Arbitration Clause:
Should legal action arise between a Customer and Hostwave.com: The Customer "YOU" (Subscriber/Client) agrees to pay all legal fees for Defendant and Plaintiff, such as Host Wave.com LLC's "Attorney Fees" and "Court Cost".
Governing Body of Law/ Jurisdiction per Host Wave's Terms of Use Agreement:
The Terms of Use, and any other agreement for Host Wave services, will be governed by and construed in accordance with the laws of the State of California, USA without reference to its conflicts of laws principles. Any litigation or arbitration between a customer and Host Wave shall take place in California, a San Diego County Court is proper jurisdiction and the customer will consent to personal jurisdiction and venue in that jurisdiction. If any provision or portion of the Terms of Use Agreement or other Host Wave agreement is found by a court of competent jurisdiction to be unenforceable for any reason, the remainder of the Terms of Use or the agreement will continue in full force and effect.
Technical Support (Extent of):
Technical Support is provided by email at support @ hostwave.com. Technical Support is only provided for the billing, creation, deletion of a web service. No programming or graphic design. All request for programming or graphic design must be submitted for review and in writing to support @ hostwave.com. Hourly rates for programming and graphic design are available. Host Wave.com LLC only provides image hosting and web hosting web services. If a User modifies the image hosting script or web hosting scripts such as items in the Script Library; Shopping Cart, Blog, etc., this voids the provided Host Wave.com LLC's Technical Support.
Acceptance of the Host Wave.com LLC's User Policy:
By choosing ANY of Host Wave.com LLC web services mentioned above and found at Host Wave.com's website - "YOU" (Subscriber/Client) accept this policy. If you unsubscribe from the service, all images and documents are automatically removed.
